Trust Administration
Wilson Law Firm represents trustees in connection with their administration of trust agreements of all types. We insure that our trustee clients are aware of their fiduciary duties required by law and their obligations imposed by the terms of the trust agreement. This may include preparing appropriate accountings to reflect the administration of the trust, providing proper notices to beneficiaries, assisting with the proper investment of the trust assets in a manner consistent with their fiduciary obligations and similar matters. We also assist with the termination of the trust at such time as final distribution is appropriate, obtaining releases from beneficiaries, or if appropriate, obtaining court approval of the administration of the trust and the discharge of the trustee. Likewise, we represent beneficiaries of trusts for a variety of purposes, such as obtaining full disclosure from the trustee of trust assets, expenses and other information necessary to insure that the beneficiary receives everything they are entitled to as a beneficiary of a trust. We have significant experience in actions to remove the trustee when the trustee has failed to properly perform their fiduciary duties required by the trust instrument or as required by law.
